Florida psilocybin bills: every attempt since 2019, and how each one ended
No bill to allow psilocybin therapy or fund psilocybin research has passed the Florida Legislature. Three such bills died without a hearing in 2021 and 2022, and the one psilocybin law Florida did pass, in 2025, made the law stricter.

The short answer
No bill to allow psilocybin therapy, study it or fund research on it has passed the Florida Legislature. Since 2019, three bills proposed therapy or a state study: HB 549 in 2021, and the companion bills HB 193 and SB 348 in 2022. All three died in their first committee without a hearing.12
The only psilocybin-specific law Florida passed in that time went the other way. The 2025 farm bill, SB 700, created s. 500.75, which makes it a first-degree misdemeanor to transport, import, sell, furnish or give away spores or mycelium capable of producing mushrooms that will contain a controlled substance such as psilocybin or psilocyn. It took effect July 1, 2025.34
Psilocybin and psilocyn are still Schedule I (893.03(1)(c)33. and 34.), and as of November 2, 2026 no psilocybin bill had been filed for the 2027 session, which opens March 2.414 For what the law says now, see are magic mushrooms legal in Florida.
What Florida's psilocybin bills proposed
2021: a licensed program. HB 549, filed by Rep. Michael Grieco (D) and titled in its text the "Florida Psilocybin Mental Health Care Act," would have had the Department of Health license psilocybin manufacturers, service centers, facilitators and testing labs to serve adults 21 and older, with no diagnosis required. It also told the Florida Department of Law Enforcement to make investigating and arresting adults 18 and older for noncommercial activity involving "entheogenic plants and fungi" "one of its lowest enforcement priorities." It died in the Professions & Public Health Subcommittee on April 30, 2021.1
2022: a study. Grieco's HB 193 and Sen. Lauren Book's (D) SB 348 asked for much less: a Department of Health study, with the Board of Medicine, of "alternative therapies," including MDMA, psilocybin and ketamine, for depression, anxiety, PTSD, bipolar disorder, chronic pain and migraines, reported by September 1, 2023. Neither authorized any use or carried money. Both were withdrawn on March 12, 2022 and died two days later.2
2025: the spore ban. Section 51 of SB 700 (Sen. Keith Truenow, R) created the spore and mycelium offense. The bill passed the Senate 27-9 and the House 88-27, and the Governor approved it May 15, 2025, as chapter 2025-22.3 The House staff analysis of the companion bill, HB 651, explained the gap it closed: spores "do not contain any psilocybin properties themselves and therefore could be considered legal under current law."5 The offense carries up to 1 year in jail and a fine of up to $1,000.4
Everything else. Twenty more bills from 2021 to 2026 mention psilocybin without changing its status, mostly because they reprint Florida's Schedule I list; marijuana and xylazine bills are the usual examples. One became law: SB 432 (2026, chapter 2026-148), on nitrous oxide and xylazine, left the psilocybin listing as it was.144
Every bill, with its outcome
The list covers the six bills that would have changed Florida's psilocybin law or funded psilocybin research, including companion bills and the Senate budget bill that carried study money. It leaves out the 20 bills that only mention psilocybin. Each record links to its Florida Senate bill page, and you can download the whole set below.

- What it would do
- An omnibus agriculture bill. Section 51 created s. 500.75, Florida Statutes: "It is unlawful to transport or offer to transport, import into this state, sell or offer for sale, furnish, or give away spores or mycelium capable of producing mushrooms or other material which will contain a controlled substance, including psilocybin or psilocyn, during its life cycle." A violation is a first-degree misdemeanor. Possession is not among the listed acts. The bill passed the Senate 27-9 on April 16, 2025 and the House 88-27 on April 29, 2025.

- What it would do
- As proposed, the Senate budget gave the University of South Florida Medical Center $1,000,000 for a "Psilocybin study in Veterans with PTSD (SF 2851)." Appropriations Committee amendment 995007 cut it to $650,000, the amount in the engrossed Senate bill. The Senate then substituted the House budget, HB 5001, which became law (chapter 2024-231) with no psilocybin line.

Psilocybin research money that wasn't funded
No Florida budget since at least 2019-20 has funded a psilocybin study. Sen. Jay Collins (R) asked twice for $3,000,000 for USF Health "to conduct a clinical trial into the efficacy of Psilocybin as a treatment for PTSD in veterans": Senate request #2851 for 2024-25, dated December 13, 2023, which planned to treat 30 veterans, and #1393 for 2025-26, dated February 18, 2025.6
The first request got furthest. The Senate's proposed 2024 budget held $1,000,000 for the study; an Appropriations Committee amendment from Sen. Danny Burgess (R) cut it to $650,000 and moved $350,000 to USF Health genetic research, and the engrossed Senate bill kept $650,000.7 The budget that became law, HB 5001 (chapter 2024-231, approved June 12, 2024), has no psilocybin line, and the 2025 request never appeared in a budget bill. None of the enacted budgets from 2019-20 through 2026-27 uses the word psilocybin.8
Florida's "alternative treatment options" law for veterans (s. 295.156, 2019) isn't a psychedelic program either. Its five listed therapies are accelerated resolution therapy, equine therapy, hyperbaric oxygen therapy, music therapy and service animal training therapy.4 For psilocybin research that is happening in Florida, see our clinical trials tracker.
Florida bill claims we checked
Some websites list Florida bills that don't say what they're described as saying. Here's what the bill records show.13
- HB 1113 (2024) is not a psychedelic therapy pilot. It's "Use of Lights and Sirens on Emergency Vehicles," which became chapter 2024-34.
- SB 504 (2025) is not a psilocybin and MDMA access pilot, pending or otherwise. It's "Department of Transportation Construction Projects," about plant materials on road projects, and it died in the Senate Transportation Committee on June 16, 2025.
- HB 549 (2022) is a marijuana legalization bill. Only the 2021 HB 549 dealt with psilocybin.
- The 2025 spore law doesn't ban possession. Section 500.75 lists transporting, importing, selling, offering, furnishing and giving away.4 Anything that contains psilocybin is still Schedule I under 893.03.
Could voters put psilocybin on the ballot?
Not as a statute. A Florida citizen initiative can only amend the state constitution. It needs petition signatures equal to 8 percent of the votes cast in the last presidential election, statewide and in half of the congressional districts, and then at least 60 percent of the vote.12
No initiative on psilocybin, psychedelics, mushrooms or "natural medicine" appears on the Department of State's list of active initiatives as of November 2, 2026. The list includes one adult-use marijuana initiative aimed at 2028, "Adult Personal Use of Marijuana" (25-01).9 We couldn't search the state's archive of past initiatives. The November 3, 2026 statewide ballot has no drug question.9
Has any Florida city or county acted?
We found no Florida city or county resolution decriminalizing or deprioritizing psilocybin. Decriminalize Nature, a national advocacy group, lists local resolutions in places such as Oakland, Ann Arbor and Somerville, Massachusetts, and none in Florida; it lists only a statewide Florida chapter.10 Such a measure wouldn't make psilocybin legal in any case, because state law still applies. The 2021 HB 549 would have reserved psilocybin regulation to the state.1
When could a new bill be filed? The 2027 calendar
In odd-numbered years, Florida's regular session opens on the first Tuesday after the first Monday in March and can't run longer than 60 consecutive days unless it's extended.12 As of November 2, 2026, the 17 bills filed for 2027 were all claim bills, and none mentions psilocybin.14 Our news post on the 2027 session has more.
| Date | What happens |
|---|---|
| November 17, 2026 | Organization session: the new Legislature convenes to choose its officers |
| November 30 to December 3, 2026 | Interim committee meetings |
| January 4 to 7 and 11 to 14, 2027 | Interim committee meetings |
| February 1 to 4, 8 to 11 and 15 to 18, 2027 | Interim committee meetings |
| March 2, 2027 | Session opens; noon deadline for filing Senate bills (Senate Rule 3.7(1)) |
| April 20, 2027 | 50th day: last day for regularly scheduled committee meetings |
| April 30, 2027 | 60th day: last day of the regular session |
Dates come from the Florida Senate.11 We couldn't confirm the House's 2027 filing deadline.
How a bill becomes law in Florida
A legislator files a bill, and it's referred to committees in that chamber; all three psilocybin therapy and study bills died at that first stage.12 To pass, a bill must be read in each house on three separate days, unless two-thirds vote to waive that, and win a majority in both houses.12
The Governor then has 7 consecutive days to act, or 15 if the Legislature adjourns the session (sine die) or takes a recess of more than 30 days in that window; a bill that isn't vetoed in time becomes law. Both houses can override a veto by a two-thirds vote. Unless the bill sets its own date, a law takes effect 60 days after the session ends.12
Questions people ask
Is there a Florida psilocybin bill in 2026?
No bill in the 2026 session would have changed psilocybin's status. The 2026 bills that mention it only reprint the Schedule I list, and none had been filed for 2027 as of November 2, 2026.14
Has Florida ever passed a psilocybin law?
Did Florida fund a psilocybin study for veterans?
When is the deadline to file a bill for 2027?
In the Senate, noon on March 2, 2027, the session's first day, under Senate Rule 3.7(1).11
