Legal psilocybin near Miami: where it's allowed, and how far
Psilocybin is illegal everywhere in Florida, so the nearest legal options are Colorado's and Oregon's licensed programs, which take adults 21+ from other states. Abroad the rules run from largely unregulated in Jamaica to banned in Mexico, and bringing any psilocybin home to Miami is a federal crime.
From our sister shop, My Mushroom Dispensary. Adults 21+ only.

The short answer
There's no legal psilocybin in Miami: Florida lists it in Schedule I, and possessing any amount is a third-degree felony.1
The nearest legal options are state-licensed programs in Colorado (Denver is 1,708 miles from MIA) and Oregon (Portland is 2,697 miles). Both serve adults 21 and older in supervised sessions at licensed centers, and neither is limited to residents.23 New Mexico's medical program isn't enrolling patients yet.4
Abroad, Jamaican officials say no law bans psilocybin, the Netherlands bans the mushrooms but its drug law doesn't cover "magic truffles," and Mexico and the Dominican Republic prohibit it. Bringing any of it back through MIA or PortMiami is a federal crime under 21 U.S.C. 952 and 955.56 Places that have only decriminalized psilocybin aren't listed here, because it's still illegal under their state law.

Miles are great-circle distances from MIA to the airport named, which we calculated with the haversine formula from OurAirports coordinates (Earth radius 3,958.8 miles) and rounded to whole miles; real routes are longer.7 We don't list nonstop flights because we couldn't confirm them.
Is there a legal psilocybin retreat in Florida?
No. Psilocybin and psilocyn are Schedule I (893.03(1)(c)33. and 34.), and possession of any amount without a prescription is a third-degree felony under 893.13(6)(a), punishable by up to 5 years in prison and a $5,000 fine (775.082, 775.083).1 Florida has no licensing program, and calling something a retreat or a ceremony doesn't change the statute. See our penalties guide and bill tracker.
Oregon: licensed service centers, open to visitors
The Oregon Health Authority (OHA) is plain about it: "Clients do not need to live in Oregon to access psilocybin services." Clients must be 21 or older, and no prescription or referral is needed.2
Every client first has a preparation session with a licensed facilitator, covering intake, informed consent, safety planning and a transportation plan. Psilocybin is bought and taken only during a supervised administration session at a licensed service center: "Products may not be purchased and taken off-site." A client may be found ineligible for thoughts of harming themselves or others, lithium use within 30 days, or a diagnosis of active psychosis at any time, and facilitators "may decline services to clients for any reason."2
OHA's public directory listed 20 service centers on November 2, 2026. Treat that as a minimum: listing is optional, and OHA says the directory "is not a comprehensive list of all OPS licensees."8
How many clients come from other states
From April 1 to June 30, 2026, centers reported 525 clients living elsewhere in the US out of 1,220 clients served. Summing the quarterly reports gives 2,114 of 6,887 from January 1, 2025 to March 31, 2026, and 2,639 of 8,107 through June 30, 2026.8 Repeat clients may be counted more than once, clients can opt out of being counted (291 did in April to June 2026), and the data don't record states, so there's no count of Floridians.
Colorado: healing centers and a limited sales license
Colorado listed 47 approved healing center licenses as of October 30, 2026: 12 standard and 35 micro.9 Services there mean a preparation session, an administration session and an integration session, supervised by a licensed facilitator.3
The rules define a participant as "a person who is 21 years of age or older and who receives Natural Medicine Services performed by or under the supervision of a Facilitator." There's no residency test, and Rule 8015 accepts ID from any US state, the District of Columbia or a US territory, or a passport.3 We found no agency page saying outright that visitors may take part, and no rule limiting services to residents.
Since August 12, 2026, emergency rules implementing HB 26-1325 let a healing center owner hold a Limited Regulated Natural Medicine Sales License and sell to participants "immediately preceding Administration Sessions," for use "solely in an Administration Session at a co-located Healing Center" (Rule 8006). There's still no take-home sale.3 A hearing on the rule revisions, including limited sales licenses, was set for November 4, 2026.9
New Mexico: a medical program that isn't enrolling yet
New Mexico's Medical Psilocybin Act (SB 219, 2025) covers patients with major treatment-resistant depression, posttraumatic stress disorder, substance use disorders, end-of-life care, or other conditions the health department approves, certified by a New Mexico-licensed clinician who holds a department permit. The Department of Health must implement the program "by December 31, 2027."10
The Department of Health's FAQ (March 2026) says "Psilocybin therapy enrollment has not yet started," with a goal of enrolling the first patients "by the end of December 2026." A proposed rule for patient enrollment, clinicians and healing centers went to a public hearing on October 2, 2026; we couldn't confirm its final adoption.4 Whether patients must live in New Mexico is unconfirmed: neither the Act nor the FAQ says.
Is psilocybin legal in Jamaica?
Jamaican officials say no law bans it. Speaking at a psychedelics summit in Montego Bay on July 15, 2021, Agriculture and Fisheries Minister Floyd Green said, "In Jamaica, the reality is that we never promulgated any laws to make psilocybin illegal here," according to the Jamaica Information Service (JIS), a Government of Jamaica agency. In the same report, JIS wrote that "Jamaica is home to many psychedelic retreats."5
Retreats operate openly. On November 24, 2023, the Ministry of Industry, Investment and Commerce announced a standardisation working group through the Bureau of Standards Jamaica and said: "Psilocybin-assisted therapy and retailed products containing micro-doses are freely accessed by local residents and tourists alike."5 We couldn't confirm that any regulations followed.
In August 2024, the Ministry of Health and Wellness said it had not approved psilocybin products for sale and warned they "can be dangerous to one's health," according to a Caribbean Media Corporation report in Caribbean Today.11 Montego Bay is 526 miles from MIA. We don't name or recommend retreats.
The Netherlands: truffles, not mushrooms
A decree of November 17, 2008 (Staatsblad 2008, 486), in force December 1, 2008, added "paddenstoelen die van nature de stof psilocine of psilocybine bevatten" (mushrooms that naturally contain psilocin or psilocybin) to List II of the Opium Act. Its explanatory note cited a rise in incidents, mainly involving foreign tourists, and noted that psilocin and psilocybin were already on List I and that a 2002 Supreme Court ruling had treated dried or processed mushrooms as List I preparations.12
"Magic truffles" (sclerotia) are different. In a VAT case decided April 10, 2026 (ECLI:NL:HR:2026:450), the Supreme Court (Hoge Raad) took as its starting point that magic truffles "vallen niet onder de Opiumwet zodat zij vrij kunnen worden gekweekt en verhandeld" (do not fall under the Opium Act, so they can be freely grown and traded). The ruling itself was about tax: truffles aren't food, so the general VAT rate applies.12 Truffles contain psilocybin, so US import law covers them.
Mexico and the Dominican Republic: illegal
Mexico's General Health Law lists psilocybin in group I of psychotropic substances, which it describes as having little or no therapeutic value, with "hongos alucinantes de cualquier variedad botanica" (hallucinogenic mushrooms of any botanical variety) among its other names (article 245). Article 248 prohibits every act listed in article 247 with group I substances, and article 249 allows only authorized scientific research.13
The one carve-out is narrow. Under article 195 bis of the Federal Penal Code, federal prosecutors won't charge possession of peyote or hallucinogenic mushrooms when the amount and circumstances suggest use in the ceremonies, uses and customs of Indigenous and Afro-Mexican peoples and communities (wording amended April 1, 2024).13 It isn't an exception for visitors.
The Dominican Republic's Ley 50-88 lists psilocybin and psilocin in Category I, covering any material or preparation containing "una cantidad cualquiera" (any quantity) of them. We read a copy hosted by the World Trade Organization and couldn't confirm it reflects every later amendment.14
The Bahamas, Cuba and Costa Rica: not confirmed
We couldn't review the current drug laws of the Bahamas, Cuba or Costa Rica, so we don't state a status for psilocybin there. Nassau is 184 miles from MIA, Havana 235 and San José 1,122.7
Clinical trials in Florida
Closer to home, psilocybin is being studied in trials with Florida sites. On November 2, 2026, ClinicalTrials.gov listed a recruiting Miami site for Compass Pathways' Phase 2/3 study of its psilocybin drug COMP360 in PTSD (NCT07570654).15 Our Florida psilocybin trials tracker lists every study with a Florida site.
A trial isn't a treatment program: participants "may or may not get any benefit," may get "the standard treatment or no treatment at all," and "can leave the study at any time and for any reason."15
Can you bring psilocybin back to Miami?
No. Federal Schedule I covers "any material, compound, mixture, or preparation, which contains any quantity" of psilocybin or psilocyn (21 U.S.C. 812(c)), so mushrooms, truffles and edibles bought legally elsewhere are included.6
21 U.S.C. 952(a) makes it unlawful "to import into the United States from any place outside thereof, any controlled substance in schedule I or II," with narrow exceptions the Attorney General can approve, such as limited quantities for scientific research. 21 U.S.C. 955 makes it unlawful "to bring or possess on board any vessel or aircraft ... arriving in or departing from the United States" such a substance unless it's manifested cargo or official supplies. That covers cruise ships and international flights at Miami. Knowing violations carry up to 20 years in federal prison (21 U.S.C. 960(b)(3)).6
No state program lets you leave with psilocybin: Oregon's products "may not be purchased and taken off-site," and Colorado's sales are only for a session at the same center.23 Once you land in Florida, possession of any amount is a third-degree felony under 893.13(6)(a), wherever it was bought.1
