Visiting Miami? Florida's psilocybin law applies to you

Yes, Florida law applies to visitors: psilocybin is Schedule I here, and possessing any amount is a third-degree felony, whatever the law is back home. On cruise ships and international flights, federal law adds its own ban.

Does Florida's psilocybin law apply to tourists?

Yes. Florida lists psilocybin and psilocyn in Schedule I, at 893.03(1)(c)33. and 34.1 Its possession law says "a person may not be in actual or constructive possession of a controlled substance" without a prescription or other authorization, with no exception for visitors, and a violation is a third-degree felony.2 That carries up to 5 years in prison.3

What's legal where you live doesn't travel. A licensed session in Oregon or Colorado changes nothing in Miami Beach, and having psilocybin shipped to a hotel or rental doesn't either: ordering it online or by mail is illegal under federal law and in every state, and no state permits mail-order sales. See our Florida law guide for the full picture.

Flying into or out of Miami with mushrooms

TSA screens for security threats, but it refers any illegal drugs it finds to law enforcement. In its own words: "TSA's screening procedures are focused on security and are designed to detect potential threats to aviation and passengers. Accordingly, TSA security officers do not search for marijuana or other illegal drugs, but if any illegal substance is discovered during security screening, TSA will refer the matter to a law enforcement officer." It adds that "TSA officers are required to report any suspected violations of law to local, state or federal authorities."4

At Miami International or any Florida airport, Florida's possession law applies.2 Psilocybin and psilocyn are also Schedule I under federal law, 21 U.S.C. 812.5 On an international flight, a separate federal law applies, the same one that covers cruise ships, below.

Can you bring mushrooms on a cruise from PortMiami?

No. PortMiami's cruise lines sail to "the Eastern and Western Caribbean, Mexico, Key West, South America and beyond," and its list of lines includes Carnival, MSC Cruises, Norwegian Cruise Line and Royal Caribbean.6 A ship that leaves for a foreign port and comes back falls under 21 U.S.C. 955.

"It shall be unlawful for any person to bring or possess on board any vessel or aircraft, or on board any vehicle of a carrier, arriving in or departing from the United States or the customs territory of the United States, a controlled substance in schedule I or II or a narcotic drug in schedule III or IV, unless such substance or drug is a part of the cargo entered in the manifest or part of the official supplies of the vessel, aircraft, or vehicle."

That's 21 U.S.C. 955 in full.7 Knowingly or intentionally bringing a Schedule I substance aboard against 955, or importing one against 21 U.S.C. 952, is punishable under 21 U.S.C. 960 by up to 20 years in prison for a first offense (up to 30 after a prior felony drug conviction), and by 20 years to life if death or serious bodily injury results from use of the substance.8

What the cruise lines say

Norwegian Cruise Line's guest conduct policy: "No illegal drugs or other illegal substances including but not limited to medical marijuana are allowed onboard or may be utilized during a Norwegian Cruise Line vacation, including during transfers to and from ships, inside terminals, during shore excursions or at our private island." Drugs "will be confiscated," and the action taken "may include removal from the ship and involvement of appropriate authorities."9

Royal Caribbean Group's policy says "No illegal drugs or other illegal substances are allowed onboard," that they "will be confiscated," and that "Marijuana, even in its medicinal form or for medicinal purposes, shall be prohibited." Consequences can include reporting to law enforcement and "Denial of boarding on any future Royal Caribbean Group cruise vacation."10 We couldn't retrieve Carnival's or MSC's policy pages; check yours before you sail.

Jamaica, Mexico and other ports of call

Norwegian warns that "foreign governments at Norwegian Cruise Line ports of call have strict laws that address drug possession," and that guests who break them "are subject to arrest and prosecution by the foreign jurisdiction (and perhaps United States or other authorities as well) and may be prevented from re-boarding the ship."9

Jamaica

"Legal in Jamaica" is too simple. Speaking at a psychedelics industry summit in Montego Bay on July 15, 2021, Agriculture and Fisheries Minister Floyd Green said, as reported by the government's Jamaica Information Service: "In Jamaica, the reality is that we never promulgated any laws to make psilocybin illegal here." He also said the ministry had been "putting in interim protocols" for people who want to take part in the industry.11 In August 2024, according to a Caribbean Media Corporation report, Jamaica's Ministry of Health and Wellness said in a statement that it had not approved psilocybin "for sale in the country," and health authorities warned that the drug and its byproducts "can be dangerous to one's health."12

Mexico

Mexico's General Health Law lists psilocybin in Group I of article 245, naming hallucinogenic mushrooms of any botanical variety among its other names. Article 248 prohibits every act listed in article 247 for Group I substances, and that list includes possession, transport, trade and use.13

Other stops

We couldn't confirm how the Bahamas and several other Caribbean ports treat psilocybin under their own laws. Don't take a port's reputation as a legal answer.

Bringing anything back

Whatever a port allows, the trip home runs through US law. Bringing psilocybin aboard a ship or plane bound for the US violates 21 U.S.C. 955, importing it violates 952, and both are punishable under 960.78 Once you're back in Florida, possession is a felony under 893.13.2

Art Basel, Ultra and Miami Music Week

Art Basel Miami Beach runs December 4 to 6, 2026.14 Ultra Music Festival is set for Bayfront Park on March 26 to 28, 2027.15 The same Florida possession law applies at every gallery party, Miami Music Week club night and festival.2

Ultra's own policy, a festival rule rather than a law, says: "We maintain a zero-tolerance policy prohibiting illicit drug use and possession. Narcotic laws are strictly enforced and police officers will be working the event in an undercover capacity." For medical problems it points people to its First Aid tents, staff, security, police or firefighters, and says "You will not get in trouble for seeking medical help," which it calls "our pledge to you."15 That pledge is Ultra's, not Florida's. The state's 911 Good Samaritan law is narrower; our help page explains it. Get medical help first either way.

Heat, sun and water

Miami's heat and surf are risks on their own, and impairment makes both worse. Keep to shade and air conditioning on hot days, and drink water. Overheating, confusion or fainting is a 911 call; the full list of warning signs is on our help page.

Swim only at beaches with lifeguards on duty, and stay out of the water and off boats if you or a friend has taken anything. Florida's DUI law (316.193) and boating under the influence law (327.35) both cover anyone impaired by "any substance controlled under chapter 893,"1617 which includes psilocybin.1 Our safety guide has the penalties and Florida's boating accident figures.

Questions people ask

Can tourists be arrested for magic mushrooms in Miami Beach?

Yes. Florida's possession law applies to "a person," with no exception for visitors, and possessing any amount of psilocybin is a third-degree felony.2

Can I take psilocybin on a cruise from Florida?

No. Federal law, 21 U.S.C. 955, bars bringing or possessing a Schedule I substance on any ship or plane arriving in or leaving the US.7 Norwegian and Royal Caribbean also ban illegal drugs on board.910

Are magic mushrooms legal in Jamaica?

It's not that simple. Jamaica's agriculture minister said in 2021 that the country never passed a law making psilocybin illegal, but its health ministry said in August 2024 that it hadn't approved psilocybin for sale, according to a Caribbean Media Corporation report.1112 Either way, bringing any back to the US is a federal crime.7
