Magic Mushrooms MiamiPsilocybin law, news and safety for South Florida

Can you order magic mushrooms online in Florida?

No. Ordering psilocybin online is illegal under federal law and in every state, no state permits mail-order sales, and in Florida buying or possessing it is a third-degree felony.

The short answer

You can't legally order magic mushrooms online to Florida. Buying psilocybin is a third-degree felony under Fla. Stat. 893.13(2)(a)2., possessing it is a third-degree felony under 893.13(6)(a), and the U.S. Postal Service says that when distributing a controlled substance is unlawful, mailing it is also unlawful under 18 U.S.C. 1716; controlled substances can go in the mail only in narrow cases, such as between DEA registrants.15 No state permits mail-order psilocybin, not even Oregon or Colorado, which license supervised sessions.8

This site is published by the team behind My Mushroom Dispensary, an online shop for adults 21+, and that doesn't change the answer: ordering psilocybin to Florida is illegal under Florida and federal law.

Is it illegal to buy shrooms online in Florida?

Yes. Florida law makes it a crime to "purchase, or possess with intent to purchase," psilocybin or psilocyn, a third-degree felony under 893.13(2)(a)2. Once a package arrives, possession is a separate third-degree felony under 893.13(6)(a). There's no small-amount misdemeanor for psilocybin; the only one in that part of the law is for cannabis.1

A third-degree felony carries up to 5 years in prison and a fine of up to $5,000.23 Those are maximums, not typical sentences; our guide to psilocybin penalties in Florida explains how sentencing, diversion and the driver license suspension work.

The website's location doesn't matter. Florida's law applies to buying and possessing psilocybin in Florida, wherever the seller is, and a shop's claim that its products are "legal" doesn't change what's in the package.1

What does federal law say about mail-order mushrooms?

Psilocybin and psilocyn are Schedule I under the federal Controlled Substances Act, which covers "any material, compound, mixture, or preparation, which contains any quantity" of them.4 Three federal rules apply to mail and online orders.

Mailing: 18 U.S.C. 1716 and USPS rules

USPS Publication 52 says: "If the distribution of a controlled substance is unlawful under 21 U.S.C. § 801-971 or any implementing regulation in 21 CFR Chapter 2, then the mailing of the substance is also unlawful under 18 U.S.C. § 1716." It allows controlled substances in the domestic mail only in narrow cases, such as when both mailer and addressee are registered with the DEA or exempt from registration (for example, law enforcement on official duty), plus approved mail-back and prescription-medicine shipments.5 Under 1716 itself, knowingly mailing something the section makes nonmailable, outside Postal Service rules, can bring a fine and up to one year in prison, and up to 20 years if it's done with intent to kill or injure.6

The communication facility rule: 21 U.S.C. 843(b)

It's a separate federal crime to use "any communication facility," which the law says "includes mail, telephone, wire, radio, and all other means of communication," in committing or facilitating a federal drug felony. "Each separate use of a communication facility shall be a separate offense," with up to 4 years in prison for each (up to 8 after certain prior federal drug convictions).7 For a seller distributing by mail, each package or message used in a felony drug sale can be charged as a separate offense.

Online ads: 21 U.S.C. 843(c)

The law also makes it a crime to knowingly or intentionally use the internet "to advertise the sale of, or to offer to sell, distribute, or dispense, a controlled substance" where that isn't authorized, again with up to 4 years in prison. Material that "merely advocates the use of a controlled substance" without trying to "facilitate an actual transaction" is excluded.7

Does any state allow psilocybin by mail?

No. Neither of the two states with licensed programs sells psilocybin to take away, let alone by mail. Oregon's health authority says a person "can only purchase psilocybin products at a licensed service center during an administration session. Products may not be purchased and taken off-site."8 Colorado's limited sales license, available since August 12, 2026, allows sales only to a participant right before an administration session, for use at the same healing center.9

So a website that claims to ship psilocybin "legally" to Florida, or anywhere, is describing something no state's law allows.

What are the risks of ordering anyway?

Scams and fake shops

Nobody licenses online psilocybin sellers, so there's no regulator to check a shop against and no licensing agency to complain to. If a seller takes the money and sends nothing, the buyer has little practical recourse, because the buyer was attempting a purchase that Florida law makes a felony.1

Mislabeled products

Products sold online can contain something other than what's advertised. FDA said the Diamond Shruumz bars, cones and gummies behind a 2024 outbreak "were available online and in person," and its tests found muscimol, psilocin, the synthetic acetylpsilocin (4-AcO-DMT), the prescription drug pregabalin and kava compounds in different samples. Florida had 6 of the 180 illnesses.10

A 2025 Oregon State University study of 12 retail "magic mushroom" edibles found psilocybin in none of them, including one labeled as containing it; the authors noted these products are also distributed online.11 Our guide to mushroom gummies and chocolate in Florida has the details.

If someone gets sick

An unregulated product comes with no recall notice, no customer service line and no ingredient list you can rely on. If someone does get sick, call Poison Control at 1-800-222-1222, or 911 for an emergency, and don't let the legal worry delay the call. Our get help now page has more.

What can a lab report (COA) show, and what can't it?

Some online sellers offer a certificate of analysis, or COA: a lab's report on a sample. Read it for what it is.

  • What it can show: which compounds a lab found in the sample it tested, the lab's name, the test date and a batch or sample number.
  • What it can't show: that the product in your package came from that batch, or that every unit in a batch matches. FDA found that even the same flavor of the same Diamond Shruumz product could vary in what it contained.10
  • What it can't fix: the law. A clean report doesn't make psilocybin legal to buy, mail or possess in Florida.1

Florida also limits home testing. Equipment used to identify controlled substances counts as drug paraphernalia under 893.145(4); the exception covers only products used solely to detect fentanyl, its analogues or xylazine, and not ones that measure quantity or potency.12

Are mushroom spores legal in Florida?

Federally, the DEA has said spores that "do not contain psilocybin or psilocin" are "not controlled under the CSA," but that "if at any time the material contains a controlled substance such as psilocybin or psilocin ... the material would be considered a controlled substance under the CSA." That's from a January 2, 2024 letter by the chief of DEA's Drug and Chemical Evaluation Section.13

Florida went further. Since July 1, 2025, Fla. Stat. 500.75 has said: "It is unlawful to transport or offer to transport, import into this state, sell or offer for sale, furnish, or give away spores or mycelium capable of producing mushrooms or other material which will contain a controlled substance, including psilocybin or psilocyn, during its life cycle."1415 A violation is a first-degree misdemeanor, punishable by up to 1 year in jail and a fine of up to $1,000.1423

The statute's list of acts includes transporting and importing into Florida as well as selling and giving away. It doesn't list possession. That isn't a loophole for what spores become: the DEA letter says material that comes to contain psilocybin or psilocyn is a controlled substance, and possessing psilocybin in Florida is a third-degree felony under 893.13(6)(a).131 Section 500.75 was created by section 51 of the 2025 agriculture bill, CS/CS/CS/SB 700 (chapter 2025-22), which the Governor approved on May 15, 2025.15

Questions people ask

Can I order shrooms online and have them shipped to Florida?

Not legally. Buying and possessing psilocybin are third-degree felonies in Florida, and USPS says mailing a controlled substance is unlawful under 18 U.S.C. 1716.15

Is it legal if the website says its mushrooms are legal?

No. Florida law turns on whether the product contains psilocybin or psilocyn, not on what the seller claims, and no state permits mail-order psilocybin.18

Are mushroom spores legal in Florida?

Since July 1, 2025, Florida law makes it a first-degree misdemeanor to transport, import into the state, sell, offer, furnish or give away spores or mycelium capable of producing mushrooms or other material that will contain psilocybin, psilocyn or another controlled substance. The statute doesn't list possession, but anything that comes to contain psilocybin or psilocyn is a controlled substance.14

Does a lab report make an online order safe or legal?

Neither. A report covers the sample a lab tested, and FDA found that the same product and flavor can vary. It doesn't change Florida or federal law.10
