Psilocybin in Florida: a dated timeline, 1970 to 2027
Psilocybin is a Schedule I drug in Florida today, and nothing on this timeline has changed that. Here are the 85 dated events that shaped the law, the research and the enforcement around it, each with the source we checked.
From our sister shop, My Mushroom Dispensary. Adults 21+ only.

What the timeline shows
It shows a state that has never loosened its psilocybin law. Florida's drug schedules list psilocybin and psilocyn in Schedule I today, as the federal schedules have since 1970.12 Every Florida bill since 2019 that would have opened a path to psilocybin therapy or a state study died, and no request for psilocybin research money made it into a final budget.568
The timeline lists 85 events from October 27, 1970 to March 2, 2027, sorted into five kinds: 17 laws, 13 court decisions, 29 policy moves (bills, budgets, agency guidance and ballots), 17 research milestones and 9 enforcement actions. Most are in Florida; others are federal or out-of-state events that change what Floridians can legally do, such as Oregon's and Colorado's licensed programs. Six are scheduled, not yet past, and say "Scheduled" at the start.
What were the big turning points?
1970 to 1978: the schedules, then Fiske
The Controlled Substances Act, enacted October 27, 1970, put psilocybin and psilocyn in federal Schedule I, and the history note to Florida's drug schedules, section 893.03, begins with ch. 73-331 (1973).12 On December 21, 1978 the Florida Supreme Court decided Fiske v. State, reversing one wild-mushroom conviction 4-3 because the statute gave that defendant no fair warning, while saying there is "no vagueness problem with the statute on its face."3 Our Fiske guide explains why that didn't legalize anything.
2002 and 2012: knowledge becomes a defense
In 2002 Florida made lack of knowledge of a drug's illicit nature an affirmative defense rather than something the State must prove, and the Florida Supreme Court rejected a facial due process challenge to it in 2012. Neither the statute nor that ruling mentions Fiske, and we found no court decision saying how they fit together.4
2021 to 2025: bills die, and the one new law restricts
Only three Florida bills filed from 2019 through 2026 were about psilocybin or psychedelic therapy: HB 549 (2021), which would have created a licensed psilocybin services program, and HB 193 and SB 348 (2022), which would have ordered a state study of MDMA, psilocybin and ketamine. All three died in their first committee.56 A $3,000,000 request for a USF psilocybin trial in veterans with PTSD reached the Senate's 2024 budget at $650,000 but not the final budget, and a 2025 request went nowhere.78 The one psilocybin-related law the Legislature did pass went the other way: since July 1, 2025, transporting, importing, selling or giving away mushroom spores or mycelium that will produce psilocybin is a first-degree misdemeanor.9
2023 to 2026: trials in Miami, products in shops
Late-stage psilocybin trials came to South Florida, including COMPASS Pathways' trials with Miami-area sites and a PTSD study listing a Miami site in 2026.10 FDA granted Breakthrough Therapy designations to psilocybin in 2018 and 2019 and national priority vouchers in April 2026, while stressing that neither is a finding of safety or effectiveness.11 On the street side, Florida's enforcement entries shift toward products: Amanita stop-sale orders, the Diamond Shruumz recall and a 2026 Miami smoke shop raid. Outside Florida, Oregon (2020) and Colorado (2022) voted in licensed programs that Floridians can travel to.1213

What's coming up?
The Florida Senate convenes on November 17, 2026 to organize after the election.14 The 2027 regular session runs from March 2 to April 30, 2027, and noon on March 2 is the Senate's deadline for filing bills.15 Any change to Florida's psilocybin law would have to start as a bill in that session. Our bill tracker will list anything filed.
How is the timeline maintained?
- One event, one source. Each row has a date, a kind, a place, one or two plain sentences and the source we checked: a statute, bill page, court opinion, registry record or agency page where one exists, and a named news outlet when only a news report covers it.
- Dates are as precise as the source. When a source gives only a month or a year, the entry shows only that, and the data file says so in a "precision" field.
- Scheduled events are labeled. Upcoming dates start with "Scheduled" and carry "status": "scheduled" in the data. We update them after they happen.
- No private names. Arrests and raids appear without the names of the people involved or the street addresses of businesses, and charges are allegations, not convictions.
- What's left out. Bills that only reprint Florida's drug schedules are left out unless they matter to psilocybin, along with events we couldn't confirm in a source we could open, and events whose only source link no longer works.
