Is there a mushroom dispensary in Miami?
No. There's no licensed psilocybin dispensary in Miami or anywhere in Florida, because psilocybin is a Schedule I drug under state law. Shops that sell "mushroom" gummies or chocolate aren't licensed dispensaries, and products like theirs have been ordered off shelves by state regulators and seized by police.

The short answer
There is no licensed mushroom dispensary in Miami, and Florida has no license to give one. Psilocybin and psilocyn are Schedule I under Fla. Stat. 893.03(1)(c)33. and 34., and selling them is a third-degree felony, up to 5 years in prison.123
Shops that sell "mushroom" gummies or chocolate are often selling one of two things: Amanita muscaria products, which aren't controlled drugs in Florida but which FDA says aren't authorized in food, or products with vague labels that may contain psilocybin or synthetic drugs, which police have seized in raids. The team that publishes this site also runs an online mushroom dispensary for adults 21+, and we'll say it plainly: shipping psilocybin to Florida is illegal under Florida and federal law, from any seller, and no state allows psilocybin by mail.

What are Miami's "shroom stores" actually selling?
Products sold as "mushroom" gummies, chocolate bars and other edibles turn up in smoke shops, vape shops, hemp stores and gas stations, according to FDA, a federally funded drug-monitoring alert that summarized online posts, and Miami police as reported by NBC 6.879 None of those shops is licensed to sell psilocybin, because no such license exists in Florida. Most of these products fall into two broad groups.
Amanita muscaria products
Amanita muscaria products contain compounds such as muscimol and ibotenic acid rather than psilocybin.4 Neither the mushroom nor those compounds appears in Florida's drug schedules, so they aren't controlled substances in Florida.1 Some shops have marketed them as "legal" magic mushrooms.6
Being uncontrolled doesn't make them legal to sell as food. On December 18, 2024, FDA told food makers that Amanita muscaria, its extracts, muscimol, ibotenic acid and muscarine "are not authorized for use as ingredients in conventional food," noted they're sometimes marketed as "legal psychedelics" or "mushroom edibles," and said: "We also recommend that people avoid eating foods with these ingredients."4
Florida's Department of Agriculture and Consumer Services acted earlier, according to news reports. In December 2022 it put a stop-sale on Amanita products at a Tampa hemp shop that called itself the first mushroom dispensary in the United States; Miami New Times, citing the shop's own announcement and an inspection report, reported that the department found a "poisonous or deleterious substance" under the state food law.6 Between early February and late May 2023, the department cited five more businesses, in Daytona Beach, Largo, Plant City, Tallahassee and Tamarac, according to department records reviewed by KFF Health News. A department spokesperson told KFF Health News that it orders businesses to stop selling these products when inspectors find them.5
Products that may contain psilocybin or synthetic drugs
The second group is the riskier one: gummies and chocolate sold as "magic mushroom" products, often without a real ingredient list. Testing has found psilocin in some and synthetic tryptamines made in a lab in others.8
In March 2025, a federally funded drug-monitoring alert reported that the Palm Beach County Sheriff's Office had found "mushroom gummy" products containing 4-acetoxy DET and 4-hydroxy DET, synthetic tryptamines; online posts it summarized said such gummies were bought at head shops, smoke shops and gas stations.7 Florida lists 4-hydroxy-DET by name in Schedule I, in a class of substituted tryptamines that also names 4-AcO-DMT.1
The Diamond Shruumz outbreak showed what that can mean. FDA counted 180 illnesses tied to the brand's chocolate bars, cones and gummies and to other mushroom chocolates, 6 of them in Florida, with 73 hospitalizations. FDA's tests found muscimol, psilocin, acetylpsilocin (4-AcO-DMT), the prescription drug pregabalin and kava compounds in different samples, and said the products were sold in smoke and vape shops and at hemp and CBD retailers.8

Do Miami shops that sell magic mushrooms get raided?
Yes. In March 2026, City of Miami police raided a smoke shop after police in an undercover operation were sold psilocybin, according to the arrest report as NBC 6 described it on March 13, 2026. The SWAT search turned up what police called 20,755 grams of "suspected psilocybin infused edibles," plus suspected 7-hydroxymitragynine (a kratom-derived compound) and large amounts of marijuana products. One man was arrested.9
A Miami police spokesman asked the public to report places that sell "these types of narcotics" so police can close "another business that's doing illegal business selling drugs to our youths."9 We found no official police release on the case and no report of its outcome, and we don't name the shop.
The Miami case isn't the only one. Our Florida psilocybin enforcement log lists 15 public-record events from 2020 to 2026, including a 2023 Miami-Dade police search of a Miami business and 2025 raids on Tampa convenience stores.
Any map listing, social media account or pop-up "market" that calls itself a mushroom dispensary in Miami isn't licensed by anyone, because Florida has no license to give. A sign or a website that says "legal" changes nothing about what's in the product or what the law says about selling it.
Do Florida's medical marijuana dispensaries sell mushrooms?
No. The dispensaries you see around Miami are medical marijuana treatment centers, licensed by the state under Fla. Stat. 381.986 to serve qualified patients with a physician certification. That law covers marijuana, not psilocybin.10
A medical card doesn't help either. Florida's possession law makes exceptions for drugs lawfully obtained from a practitioner or by valid prescription, or as otherwise authorized by chapter 893, and Schedule I is defined as drugs with "no currently accepted medical use in treatment in the United States."21 People in Florida do receive psilocybin legally in FDA-regulated research: see our list of psilocybin clinical trials in Florida.
What does "dispensary" mean where psilocybin is legal?
Even in the two states with licensed psilocybin programs, there's nothing like a walk-in mushroom store. Both run supervised programs for adults 21 and older, and neither lets you buy psilocybin to take home.
Oregon: service centers
Oregon licenses psilocybin service centers. You must be 21 or older; no prescription or referral is needed, and you don't have to live in Oregon. You attend a preparation session with a licensed facilitator first, then an administration session at the service center. Oregon's health authority puts it plainly: "Products may not be purchased and taken off-site."11
Oregon's public licensee directory listed 20 service centers on November 2, 2026. Listing is optional, so the real number may be higher.12
Colorado: healing centers
Colorado's voter-approved program defines a participant as a person "twenty-one years of age or older," and its services include at minimum a preparation session, an administration session and an integration session.14 The state listed 47 approved healing center licenses (12 standard, 35 micro) as of October 30, 2026.13
Since August 12, 2026, a healing center owner can hold a limited sales license, but only to sell to a participant right before an administration session, for use at that same healing center.15 Even then, nobody leaves with product.
