Florida's Legislature organizes November 17, and no psilocybin bill is filed for 2027

Florida's newly elected Legislature meets on November 17, 2026, to organize, and its 2027 regular session opens March 2, 2027, with a noon deadline that day for filing bills. As of November 2, 2026, no 2027 bill mentioned psilocybin, psychedelics or ibogaine, and the only 2026 bills that mentioned psilocybin just reprinted the Schedule I list.

When does the Florida Legislature meet?

First comes an organization session. Article III, section 3(a) of the Florida Constitution says that "on the fourteenth day following each general election the legislature shall convene for the exclusive purpose of organization and selection of officers."1 With the general election on November 3, the Constitution sets that meeting for Tuesday, November 17, 2026. It isn't a session for passing bills.

The regular session follows in March, as the Constitution requires in odd-numbered years.1 The Senate's calendar lists these dates:2

Florida's 2027 regular session dates
DateWhat happens
March 2, 2027Session convenes; noon is the deadline for filing bills (Senate Rule 3.7(1))
April 20, 202750th day, the last day for regularly scheduled committee meetings
April 30, 202760th day, the last day of the regular session

Has anyone filed a psilocybin bill for 2027?

No. A full-text search of 2027 bills on the Florida Senate's site on November 2, 2026, returned zero results for "psilocybin," "psychedelic" and "ibogaine."3 Filing has barely started: the 17 bills listed for 2027 on the Senate's site are all claim bills, filed August 7, 2026, the claim-bill deadline.24

That says nothing about what lawmakers may file before March 2. It means only that nothing is on file yet. We'll add any new bill to our Florida psilocybin bill tracker when it appears.

Did the 2026 session change anything for psilocybin?

No. Only two 2026 bills contained the word "psilocybin": SB 432 and its House companion, HB 309.5 Both mentioned it only because they reprinted Florida's Schedule I list.

SB 432, "Intoxicating Substances," by Sen. Yarborough and the Senate Fiscal Policy Committee, passed the Senate 37-0 on March 4, 2026, and the House 111-0 on March 9. The Governor approved it on June 16, 2026, and it became Chapter 2026-148. The House laid HB 309 on the table on March 9, the day it passed SB 432.6

The law creates "Meg's Law," which bars tobacco and nicotine dealers from selling nitrous oxide on their licensed premises. It also exempts certain FDA-approved xylazine animal drug products from Schedule I and creates the crime of trafficking in xylazine.6 Its section 3, effective July 1, 2026, rewrote the Schedule I paragraph to handle xylazine, and in doing so reprinted "33. Psilocybin." and "34. Psilocyn." unchanged. The rest of the law took effect October 1, 2026.7

The current statute still lists psilocybin at 893.03(1)(c)33., psilocyn at (c)34. and ibogaine at (c)18.8

Can psilocybin's status change without a new law?

In one narrow way. Section 893.0355 lets Florida's Attorney General adopt rules "rescheduling specified substances to a less controlled schedule, or deleting specified substances from a schedule, upon a finding that reduced control of such substances is in the public interest."9

In making that finding, the Attorney General must give "great weight" to federal scheduling rules, to keep Florida and federal drug law uniform.9 Federal action weighs heavily, but the statute lists seven other factors too, from the substance's potential for abuse to any risk to public health.9

Why it matters in Miami

If anything changes for psilocybin in Florida in 2027, it would most likely start as a bill, and the Senate's deadline for filing one is noon on March 2, 2027. As of November 2, none exists, and the state's November 3 ballot has no drug measure either (see our ballot story).

Until the law changes, possessing any amount of psilocybin in Miami-Dade or anywhere in Florida is a third-degree felony under 893.13(6)(a).10 Florida's last three budgets also contain no psychedelic research money, as our story on federal ibogaine funding explains.
