Idaho votes on who can legalize drugs; two Oregon cities vote on psilocybin businesses
Idaho voters decide on Tuesday, November 3, 2026, whether to amend their constitution so that only the Legislature can legalize marijuana, narcotics or other psychoactive substances. Also on Tuesday, Reedsport and Redmond, two cities in Oregon, where licensed psilocybin services are legal, ask voters whether to keep psilocybin businesses out.

What would Idaho's HJR 4 do?
House Joint Resolution 4 adds a new subsection to Section 26, Article III of the Idaho Constitution. Its key sentence: "Effective immediately upon adoption by the voters of Idaho, only the legislature of the state of Idaho shall have power and authority to legalize" a long list of activities, from producing and selling to possessing and using, "of marijuana, narcotics, or other psychoactive substances."1
The question on the ballot asks whether the constitution should be amended "to provide that only the Idaho Legislature shall have power and authority to legalize" those same activities.1 The text doesn't mention citizen initiatives by name.
The Idaho House passed the resolution 58-10-2 on March 5, 2025, and the Senate passed it 29-6-0 on March 11, 2025.2
The statement of purpose, prepared by the resolution's proponents in the Legislature, says "legalization and normalization of unlawful drugs is in direct conflict with the Constitutional mandate." Its fiscal note says the amendment "proposes no changes to existing statutes" and that, according to the Secretary of State, the cost of any ballot measure is "not more than $200,000.00."3
What is Reedsport, Oregon, voting on?
Reedsport's question reads: "Should electors ban the establishment of psilocybin related businesses within the City of Reedsport?" The city says a "Yes" vote "will establish a ban," while a "No" vote "will allow the establishment of psilocybin related businesses to operate within Reedsport."4
According to the city, voters enacted a temporary two-year ban in November 2022, and in November 2024 the city passed Ordinance 2024-1215 "to permanently ban psilocybin related businesses." The referral is made under ORS 475A.718, which lets a council send voters an ordinance prohibiting state-licensed psilocybin manufacturers or service centers.4 The city's page doesn't explain why a vote is needed after the 2024 ordinance.
What is Redmond, Oregon, voting on?
Redmond is asking voters whether to extend its two-year ban on psilocybin service centers, The Source Weekly in Bend reported on August 25, 2026. The City Council voted 6-1 on August 11 to send it to voters; without an extension, the current ban would expire at the end of 2026.5
The paper reported that Redmond voters approved a ban with 53% in 2022 and extended it with 55% in 2024.5 We couldn't confirm the measure number or the exact ballot wording from an official source, so they're not included here.
Where does Oregon's program stand?
Oregon licenses supervised psilocybin sessions for adults 21 and older at service centers. The Oregon Health Authority's public directory listed 20 service centers on November 2, 2026; the agency notes that listing is optional, so that's a floor, not a full count.6
Many clients travel in. In the second quarter of 2026, 525 of the 1,220 clients served reported living in the U.S. outside Oregon, according to the agency's data file.7 Local bans like Reedsport's and Redmond's decide where new centers can open.
Why it matters in Miami
Florida has no psilocybin or drug measure on its own ballot, as our Florida ballot story explains. Tuesday's votes elsewhere are a reminder that the national picture isn't one-way: a state is voting on whether to reserve legalization for its Legislature, and cities inside a legal-psilocybin state are deciding whether to stay closed.
For Miami readers weighing a trip to Oregon's regulated program, local opt-outs shape the map. Psilocybin remains a Schedule I drug in Florida under 893.03(1)(c)33.,8 and possessing any amount here is a third-degree felony under 893.13(6)(a), wherever it was bought.9 Our guide to legal psilocybin options near Miami covers what's allowed where.
