Is psilocybin legal in Miami?

No. Psilocybin and psilocyn, the active compounds in magic mushrooms, are Schedule I drugs under Florida law, which applies in Miami the same as everywhere else in the state.1 Possessing any amount is a third-degree felony, punishable by up to 5 years in prison and a $5,000 fine.2,3,4

No store, dispensary, delivery service or retreat can sell or hand out psilocybin legally in Florida: selling or delivering it is also a third-degree felony, and federal law lists it in Schedule I too.2,6 The main legal routes open to someone in Miami are FDA-regulated clinical trials and licensed programs in Oregon and Colorado for adults 21 and older.

One thing to know about us: this site is published by the team that runs My Mushroom Dispensary, an online shop for adults 21+, and that changes nothing above, because ordering psilocybin by mail is illegal under federal law and in every state, Florida included.5

Miami questions, short answers

Each answer is checked against Florida statutes, court records or agency data. Tap through for the detail.

  • Are magic mushrooms legal in Florida?: No.

Psilocybin and psilocyn are Schedule I drugs under Fla. Stat. 893.03(1)(c), illegal to possess, buy or sell.

  • Possessing a small amount?: Felony.

Possession of any amount is a third-degree felony under 893.13(6)(a), with maximum penalties of 5 years and $5,000.

  • A trafficking threshold for psilocybin?: None.

Florida's trafficking law, 893.135, doesn't list psilocybin or psilocyn, so state charges for any amount come under 893.13.

  • Has any Florida city decriminalized it?: None found.

No Florida city or county has adopted a decriminalization or deprioritization measure that we could find, and possession is a felony statewide.

  • Did the Fiske case make wild mushrooms legal?: No.

The 1978 ruling reversed one conviction as applied and said the statute has "no vagueness problem" on its face.

  • Nearest state with licensed adult sessions?: Colorado.

Colorado listed 47 approved healing center licenses on October 30, 2026. Denver's airport is about 1,708 miles from MIA in a straight line: see legal options near Miami.

Federal law makes mailing psilocybin a crime, and no state allows mail-order sales. Ordering online, explained.

  • Does calling 911 for an overdose protect you?: Partly.

Florida's 893.21 covers possession and paraphernalia charges when the evidence came from seeking help, but not sale or delivery.

What a psilocybin charge can mean

Possessing, buying, selling or bringing psilocybin into Florida are each third-degree felonies, and a sale charge becomes a second-degree felony, with up to 15 years, within 1,000 feet of a park, college, place of worship, a school between 6 a.m. and midnight, or another listed place.2,3 Those are maximums, not typical sentences. For a third-degree felony that isn't a forcible felony and scores 22 points or fewer, the judge must impose a sentence outside state prison unless it finds in writing that this could endanger the public.3 The penalties guide has the full table, the driver license rules and how diversion works.

Is Florida changing the law?

Not toward legalization so far. Only three Florida bills since 2019 have proposed psilocybin therapy or a state study of it, HB 549 in 2021 and HB 193 and SB 348 in 2022, and all three died in their first committee without a hearing.7 We found no Florida city or county measure to decriminalize or deprioritize psilocybin.18 In 2025 the Legislature moved the other way, making it a misdemeanor to sell, give away or transport spores that can produce psilocybin mushrooms.8 See the bill tracker.

Psilocybin research in South Florida

Inside Florida, FDA-regulated clinical trials are the main legal way to receive psilocybin, for people who qualify. As of November 2, 2026, COMPASS Pathways' COMP360 study in post-traumatic stress disorder (NCT07570654) listed a recruiting site in Miami on ClinicalTrials.gov.9 The trials tracker lists every Florida study.

Mushroom dispensaries, smoke shops and gummies

Florida has no licensed psilocybin dispensary, and "mushroom" candy sold in shops has held a mix of substances: when the FDA tested Diamond Shruumz bars, cones and gummies in 2024, it found psilocin, a synthetic tryptamine (4-AcO-DMT), muscimol, pregabalin and kava compounds in various combinations, and Florida had 6 of the outbreak's 180 cases.12 In March 2026, NBC 6 reported that City of Miami police seized more than 20 kilograms of suspected psilocybin edibles from a Miami smoke shop; those are police allegations.13 Read mushroom dispensaries in Miami, gummies and chocolate bars and the enforcement log.

Safety and help in Miami

The National Institute on Drug Abuse says psilocybin "typically raises blood pressure and heart rate," and that its health risks apply "particularly when unsupervised and outside of a research study and clinical supervision."14 In an emergency, call 911. For a suspected poisoning, call Poison Control at 1-800-222-1222, answered for Miami-Dade 24 hours a day by the Florida Poison Information Center in Miami.15 Read safety and risks, or go straight to get help now.

Wild mushrooms and the Fiske case

In Fiske v. State (1978), the Florida Supreme Court voted 4 to 3 to reverse a conviction for possessing psilocybin in wild mushrooms, because the statute "does not advise a person of ordinary and common intelligence that this substance is contained in a particular variety of mushroom."16 It didn't make wild mushrooms legal. The court said "There is no vagueness problem with the statute on its face," and it reversed only as the law was applied in that case. Read wild mushrooms and the Fiske case.

Visiting Miami or leaving on a cruise

Florida's drug laws apply to visitors exactly as they do to residents, and bringing psilocybin into the state is its own third-degree felony.2 Federal law also makes it a crime to bring or possess a Schedule I drug on any ship or plane arriving in or leaving the United States, which covers cruises and international flights.17 Read visiting Miami.
